**PLEASE NOTE: The Planning Commission action is final action on any item with a notation of "FINAL ACTION". Any aggrieved person may appeal Final Action of the Planning Commission to the City Council by filing a Notice of Appeal with the City Clerk within 14 days following the action of the Planning Commission. **

The Planning Commission action on all other items is a recommendation to the City Council or County Board.

[Commissioner Sunderman absent] Approval of minutes of the regular meeting held August 12, 2009. ** APPROVED, 6-0 (Sunderman absent; Lust abstained; Taylor absent at time of vote) ** Election of Chair and Vice-Chair for two-year term. Lynn Sunderman elected Chair and Michael Cornelius elected Vice-Chair, 7-0 (Sunderman and Taylor absent). 1. CONSENT AGENDA: (Public Hearing and Administrative Action) COMPREHENSIVE PLAN: 1.1 Comprehensive Plan Conformance No. 09009, to review as to conformance with the 2030 Lincoln-Lancaster County Comprehensive Plan, a proposed amendment to the Lincoln Center Redevelopment Plan amending an existing project known as the Lincoln Mall Capitol Environs Redevelopment Project, to expand the boundary to include the public rights-of-way of Centennial Mall from the south side of K Street to the mid-point of R Street (previously M Street).  The Lincoln Center Redevelopment Plan Area is generally bounded by Salt Creek, Interstate 180 and "R" Street on the north, 17th Street on the east, "G" Street on the south, and Salt Creek, 2nd Street and Sun Valley Boulevard on the west.  Staff recommendation: Conformance with the Comprehensive Plan Staff Planner: Brandon Garrett, 441-6373, bgarrett@lincoln.ne.gov Planning Commission recommendation: A FINDING OF CONFORMANCE WITH THE COMPREHENSIVE PLAN, 7-0 (Sunderman and Taylor absent). Public hearing before City Council tentatively scheduled for Monday, September 21, 2009, 3:00 p.m. 2. REQUESTS FOR DEFERRAL: 3. ITEMS REMOVED FROM CONSENT AGENDA (Public hearing and Action): 3.1 ____________________ 3.2 ____________________ 4. PUBLIC HEARING AND ACTION: COMPREHENSIVE PLAN: 4.1 Comprehensive Plan Conformance No. 09005, to review as to conformance with the 2030 Lincoln-Lancaster County Comprehensive Plan, a proposed amendment to the Lincoln Center Redevelopment Plan, to add the "Block 68 Redevelopment Project" including a hotel and entertainment complex, mixed-use residential and commercial building with retail on the first floor, and parking facility for the proposed uses. The Project Area is located on the block bounded by 10th, 11th, M and N Streets. The Lincoln Center Redevelopment Plan Area is generally bounded by Salt Creek, Interstate 180 and "R" Street on the north, 17th Street on the east, "G" Street on the south, and Salt Creek, 2nd Street and Sun Valley Boulevard on the west. Planning Commission recommendation: A FINDING OF GENERAL CONFORMANCE WITH THE COMPREHENSIVE PLAN, WITH THE EXCEPTION OF THE "PARK BLOCKS" SPECIFICATION FOR M STREET, 5-3 (Esseks, Taylor, Larson, Francis and Lust voting 'yes'; Partington, Gaylor Baird and Cornelius voting 'no'; Sunderman absent). Public hearing before City Council tentatively scheduled for Monday, September 21, 2009, 3:00 p.m. 5. CONTINUED PUBLIC HEARING AND ACTION: CHANGE OF ZONE: 5.1 County Change of Zone No. 09018, a text amendment to the Lancaster County Zoning Resolution, amending Article 2, Definitions, and Article 4, Special Permit, to add expanded home occupations; amending Article 13, Special Permit, to allow expanded home occupations by special permit in the AG zoning district and setting forth conditions of approval; and amending Article 15, Additional Use, Home Occupations, to revise the conditions of approval for home occupations carried on within a dwelling unit or accessory building.
