Exclusion Areas

The arterial street and neighborhood park/trail fees have exclusion areas in which these impact fees are not collected. No impact fees are spent on improvements in these areas for the excluded category.

Arterial Streets

In the Downtown/Antelope Valley Redevelopment exclusion area, arterial street impact fees are not collected. The City determined that this area should be excluded from the arterial street impact fee in order to encourage redevelopment in this area. (Section 27.82.070)

Parks/Trails

The neighborhood park/trail exclusion area is a large area covering 50 square miles in which the park/trail impact fees are not collected. This exclusion area was adopted because neighborhood parks and trails are already substantially developed within it. (Section 27.82.070 (a) (5))

Exemption Areas

The City Council adopted "category exemption" status from impact fees for developments with agreements to fund or construct eligible impact fee improvements. These written agreements or approvals must have been completed prior to June 1, 2002. The development was granted exemption from the specific impact fee category in which it contributed improvements.

To have been eligible, the development would have contributed facilities such as:

  • 16 inch or larger water mains, water pump stations or reservoirs
  • 10 inch or larger trunk wastewater mains
  • through lanes in the arterial streets
  • dedicated land for public neighborhood parks.

Any site-related improvements were not eligible for the exemption of impact fees. Examples of ineligible improvements are construction of adjacent 12 inch water mains, collector or local road improvements, dedication of utility easements and dedication of trail easements.
